These Terms of Use (“Terms”) govern your use of the website www.sdfood.sdpay.in(the “Website”) and the “SD Food” mobile application (the “App”). The Website and App are collectively referred to as the “Platform”.

Please read these Terms carefully before using the Platform. If you do not agree to these Terms, you must not use the Platform and should uninstall the App immediately.

By downloading, installing, accessing, or using the Platform, you agree to be bound by these Terms and all related policies of SD Food, including but not limited to the Privacy Policy and Cancellation & Refund Policy, as updated from time to time. These Terms form a legally binding agreement under the applicable laws of India.

The Platform is intended for:

  1. Individuals who are 18 years of age or older, and
  2. Corporate or legal entities, duly registered under applicable Indian laws.

USE OF THE PLATFORM AND SERVICES

All commercial and contractual terms relating to products and services are offered by and agreed upon solely between Buyers and Merchants listed on the Platform. These include, without limitation, pricing, applicable taxes (including GST), delivery charges, payment methods, delivery timelines, warranties, and after-sales services.

SD Food acts only as a technology facilitator and does not:

  • Control or determine the terms of sale between Buyers and Merchants;
  • Take ownership, possession, or title of any food items or products;
  • Assume any liability arising out of contracts between Buyers and Merchants.

SD Food may provide support services such as order management, payment collection, logistics support, or customer care to Merchants under independent agreements.

SD Food shall not be responsible for:

  • Any non-performance or breach of contract by a Merchant;
  • Poor quality, quantity, or taste of food items;
  • Incorrect, delayed, or incomplete orders;
  • Menu items being unavailable or out of stock;
  • Any loss, injury, or damage caused by food or services provided by Merchants.

Menu descriptions, prices, and images displayed on the Platform are provided by Merchants. Images are illustrative only and may not exactly match the actual food delivered.

PERSONAL INFORMATION PROVIDED BY YOU

To use the Platform, you must create an account by providing certain personal information such as:

  • Name
  • Mobile number
  • Email address
  • Delivery address

You may also voluntarily provide additional profile information. You are responsible for maintaining the accuracy of your information and for safeguarding your account credentials.

Your personal data will be processed in accordance with the Information Technology Act, 2000, and applicable Indian data protection laws, as detailed in our Privacy Policy.

DELIVERY TERMS

  • Delivery timelines shown on the Platform are estimated and may vary due to traffic, weather, merchant delays, or other unavoidable circumstances.
  • Orders will be delivered only to the address provided at checkout.
  • Any change in delivery location may result in cancellation or additional delivery charges, at SD Food’s sole discretion.
  • If delivery fails due to incorrect address, lack of instructions, or unavailability of the customer, the order shall be deemed delivered and no refund shall be issued.
  • SD Food’s responsibility ends once the order is delivered.

PAYMENTS

  • Payments may be made using UPI, debit cards, credit cards, net banking, wallets, or other RBI-approved payment methods.
  • All payments are processed through secure third-party payment gateways compliant with RBI regulations.
  • SD Food does not store card details.
  • You must use payment instruments legally owned by you.
  • SD Food disclaims liability for unauthorized transactions due to user negligence.

CANCELLATION & REFUNDS

  • SD Food reserves the right to cancel any order due to reasons including but not limited to:
    • Unavailability of items
    • Merchant issues
    • Delivery location outside service area
    • Force majeure events
  • Refunds, if applicable, shall be processed as per the Cancellation & Refund Policy and credited to the original payment method within the timelines prescribed by Indian banking regulations.

PROHIBITED ACTIVITIES

Users shall not engage in activities including but not limited to:

  • Violating any applicable Indian law or regulation;
  • Posting abusive, obscene, defamatory, hateful, or unlawful content;
  • Uploading misleading, fraudulent, or spam content;
  • Impersonating another person or entity;
  • Collecting personal data of others without consent;
  • Harassing, threatening, or abusing other users or merchants.

SD Food reserves the right to:

  • Remove or edit content;
  • Suspend or terminate accounts;
  • Cooperate with law enforcement agencies where required.

AMENDMENTS

SD Food may modify these Terms at any time by posting updated versions on the Platform. Continued use of the Platform after such changes constitutes acceptance of the revised Terms.

GOVERNING LAW & JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of India.
All disputes shall be subject to the exclusive jurisdiction of courts located in India.
